This Agreement constitutes a legally binding contract between you ("client," "customer," "you," "your") and Bollman Landscape Mgmt. LLC.

All content on the Website — including text, graphics, photographs, project portfolios, design renderings, logos, and trademarks — is owned by Bollman Landscape Mgmt. LLC or its licensors and is protected by U.S. intellectual property laws. Design concepts, drawings, plans, and renderings produced by Bollman Landscape Mgmt. LLC in the course of a project remain our intellectual property unless otherwise agreed in writing. Unauthorized copying, modification, redistribution, or commercial use is prohibited.

Your mobile phone carrier and your SMS service provider are not responsible for the messages sent by Bollman Landscape Mgmt. LLC.

13. Termination

We reserve the right to suspend or terminate your access to the Website or our services at any time, with or without notice, if we believe you have violated these Terms or engaged in conduct that is harmful, unlawful, or otherwise inconsistent with the spirit of this Agreement. Upon termination, you must immediately cease use of the Website and our services.

14. Proposals, Contracts, and Project Agreements

• Estimates and Proposals: Estimates and proposals provided by Bollman Landscape Mgmt. LLC are valid for the period stated within the document and are subject to change based on site conditions, material availability, scope changes, or revisions requested by the client.
• Project Agreement: All design and construction work is governed by a separate written project agreement signed by both parties. In the event of any conflict between these Terms and a signed project agreement, the project agreement shall control with respect to that project.
• Deposits and Payment Schedule: A deposit may be required to schedule and commence work. Progress payments and final payment are due in accordance with the payment schedule set forth in your signed project agreement.
• Change Orders: Any modifications to the agreed-upon scope of work must be documented in a written change order and may result in adjustments to project pricing and timeline.

15. Project Scheduling and Site Access

• Scheduling: Project start dates and timelines are estimates and may be affected by weather, material lead times, permitting, subcontractor availability, and conditions outside our reasonable control.
• Site Access: Client agrees to provide Bollman Landscape Mgmt. LLC and its crews with safe, unobstructed access to the project site during normal working hours throughout the duration of the project, including access to water and electrical service where reasonably required for the performance of work.
• Utilities and Locates: Prior to any excavation, we will request applicable underground utility locates as required by law. Client is responsible for disclosing any private utilities, irrigation lines, low-voltage wiring, or other buried infrastructure that may not be identified by public locate services.
• Permits and Approvals: Where applicable, Client is responsible for any HOA or architectural review approvals unless we have agreed in writing to handle them on Client's behalf.

16. Cancellation and Refunds

Cancellation rights, refund eligibility, and any associated fees are governed by the cancellation provisions set forth in your signed project agreement. Where no project agreement has yet been executed, deposits and pre-construction fees may be non-refundable to the extent they cover design work, site assessments, or materials already ordered.

17. Work-Site Safety and Property

• Work Zones: During active construction, portions of the project site may be unsafe for foot traffic, pets, or children. Client agrees to keep individuals and animals clear of designated work zones.
• Existing Conditions: Bollman Landscape Mgmt. LLC will exercise reasonable care to protect existing structures, landscaping, and features on the property. However, we are not responsible for pre-existing conditions, latent defects, or damage to undisclosed underground items.
• Plant and Material Warranties: Any warranties on plant material, hardscape installation, or workmanship are as expressly set forth in your signed project agreement. No other warranties, express or implied, apply.

18. Limitation of Liability

To the fullest extent permitted by law, Bollman Landscape Mgmt. LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Website or our services, or from any project performed by Bollman Landscape Mgmt. LLC, including but not limited to lost profits, loss of use, or damage to data. Our total aggregate liability for any claim arising out of or relating to these Terms or our services shall not exceed the amount actually paid by you to Bollman Landscape Mgmt. LLC for the specific service giving rise to the claim.

19. Indemnification

You agree to indemnify, defend, and hold harmless Bollman Landscape Mgmt. LLC and its members, employees, contractors, affiliates, and partners from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Website or our services, your violation of these Terms, or your violation of any applicable law or third-party right.
